What is a cash for keys agreement?
It is a voluntary contract in which a tenant agrees to vacate by a certain date and release claims in exchange for payment. Landlords use buyouts to recover units without the cost, delay, and risk of no-fault eviction procedures. Tenants trade protections and below-market rent for cash. Because the tenant is giving up legal rights, the terms deserve the same scrutiny as any settlement.
What are the rules for buyouts in Los Angeles?
For RSO units, the City of Los Angeles Tenant Buyout Notification Program (LAMC section 151.31) requires landlords to give tenants a city disclosure notice of their rights before negotiating, file executed buyout agreements with the housing department, and honor the tenant's right to cancel the agreement at any time up to 30 days after signing. Agreements made without the required disclosures can be rescinded by the tenant. Other Southern California cities have adopted similar buyout ordinances.
How much should a buyout be?
There is no statutory price, but the floor worth knowing is what the landlord would owe anyway for a lawful no-fault eviction: at least one month of rent under AB 1482, and formula-based relocation assistance for covered Los Angeles units that can run much higher depending on tenancy length, income, age, and disability. The real value also reflects the gap between your current rent and market rent, moving costs, and how strong the landlord's alternatives actually are. First offers are rarely the ceiling.
Do I have to accept a buyout offer?
No. Declining a buyout is not a ground for eviction, and repeated pressure after a clear refusal can constitute harassment under the Los Angeles Tenant Anti-Harassment Ordinance. Do not sign on the spot, get every term in writing including the payment schedule, and have the agreement reviewed before you commit.
